The Permanent Representatives Committee, also known as COREPER II, will again consider the Digital Omnibus at its meeting on 21/10/2026, following two previous postponements on 07/10/2026 and 11/10/2026, because of an objection raised by Germany in relation to a provision of the Data Act.

It is assumed that the objection raised by Germany has been dealt with through diplomatic negotiations in the interim, so, unless other objections materialise between now and the scheduled meeting, which seems unlikely, the text will be approved by the COREPER II Ambassadors, including nine proposed amendments to GDPR.

The text to be approved by Ambassadors will then represent the formal negotiating position of the Council in its negotiations with the Parliament which are forecast to commence in Q1/Q2, 2027

Privacy Next has previously expressed disappointment at the lack of ambition in the Council position when compared to the text proposed by the Commission, especially on GDPR provisions concerning identifiability, scientific research and AI processing. See our post here.
